Who can use the Site?

Realstoriz.com (the “Site”) is an Internet web site owned and operated by DotCom Prodigy, Inc. - a Toronto, Canada-based company. On this Site, anyone aged thirteen years or older can share interesting life stories with its readers. The Site reserves the right to modify these Terms of Use at any time and without preliminary notice. By using the Site, you agree with the most recent version of these Terms of Use. If you do not agree with these Terms of Use, or are less than 13 years old, refrain from using the Site.

 

What kind of stories are there on the Site?

The Site aims to store any type of stories stories from real life, about anyone, on any subject, from any time.

 

Are all stories true?

While the Site aims to collect true stories, it does not guarantee that all posted stories are in fact true. If you think that a certain story is not true, you are free to leave a comment for that story and share your thoughts about it. You are free to use your own judgment or be sceptical. The content of the Site is not moderated and reflects the personal opinions, thoughts and experiences of the posters.

 

What postings are prohibited?

Stories containing elements described below will be deleted from the Site on a best effort basis:

- Commercial and political advertising

- Tips on buying and/or selling securities, services or goods

- Hateful, obscene, or racial/religious/sexual discriminatory content

- Infringement of anyone’s intellectual property, any copyrights, trademarks,

  commercial secrets

- Any violations of the legal rights of Site’s readers, including, but not limited to,

  harassment, threats, denigration, insults, etc.

- Any violations of current country, province, state, region or international laws

- Stories containing obscene or sexual content

You will be held responsible for proving that the material is in accordance with all applicable laws, shall such a need arise.

 

Legal disclaimer

The information on the Site may be untrue, harmful or unpleasant and the Site cannot be held liable for any loss or damages including, but not limited to, material damages, claims of defamation, loss of information, loss of service or errors caused by the inability to use the site at any time.

The information on the Site is for entertainment use only and provided “as is”, without any kind of warranty. This information reflects personal opinions of the individuals who post entries on a wide range of subjects and is not the opinions, statements of advice or suggestions of the Site or any person or entity affiliated with the Site. The information on the Site is very lightly moderated, however the Site has no obligation to review or approve it. You will use the information from the Site at your own discretion and risk. If you are offended by the information on the Site, refrain from using the Site.

The Site may encounter interruptions or errors in its operation. Although the Site will be kept free from any harmful software components on a best efforts basis, protection against such components is your responsibility.

You may access the Site only for non-commercial purposes.

The Site reserves itself the right to revoke your access to the Site at any time and for any reason without providing any explanations.

By posting stories or comments on the Site, you are providing the Site a continuous right to use, reproduce, edit, publish, distribute, transmit, sublicense and sell any such information. The Site reserves the right to edit or delete any information at any time. The site reserves the right to delete any information that, in its sole discretion, violates any rules that are described in these Terms of Use, but is under no obligation to do so.

The Site reserves the right to disclose any information in its possession, as requested by any applicable law, governmental request or legal process.

 

Commercial terms

Shall the Site receive any royalties from other companies for rights to reproduce your story in those companies’ online, broadcasted, or printed media, the Site will share 70% of those royalties with you. This will be done on a per-story basis: royalties will be documented and received separately for each story and eventually paid to you. The Site will contact you via the email address submitted along with your story. The Site will not accept any types of communication other than email. If the Site will receive a mailing error message or will not receive any replies from you within 3 months after attempting to contact you to share the royalties, you will permanently lose the right to claim your share of royalties for the commercialized story. It is your responsibility to provide a valid email address when posting the story on the Site.

If the Site will allow other companies to reproduce your story without receiving monetary compensation for that, the Site will not have any obligations to you, your agents or persons/companies affiliated with you.

 

Trademarks

“Realstoriz” is the trademark of the Site. Copying, using, redistributing or reproducing the Site’s trademarks without the written permission of the Site or entities or persons affiliated with the Site is prohibited. The only instance of legally copying the trademark is bookmarking stories on other sites using the "Bookmark" button. Any other trademarks within the content of the Site are trademarks of their respective owners.

 

Copyright policy

The Site has instituted procedures to receive written notification of claimed infringements and to process such claims in accordance with the Canadian Copyright Act and with the Digital Millennium Copyright Act (the DMCA). Any person or entity who believes its copyrights are being infringed can use the Report story functionality provided on the Site. The notice of infringement should contain the followings:

1. An electronic signature, if possible, of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed (if part of a story), or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. [Please include an infringing story’s URL with your submission – even though the submission will mark that story as reported. If possible, specify any IDs, passwords, or other authorization to your site, required to investigate and verify the infringement. Please specify date, time, and time zone from which the material was observed]
4. Information reasonably sufficient to permit the service provider to contact the complaining party – required fields in the Report story form should be populated.
5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law – please include it in the Notes section.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send one Notice of Infringement for each story that infringes your or your client’s copyrights.
